eSecure Docs Affiliate Program Terms of Service

This Affiliate Marketing Agreement (“Agreement”) is made between eSecure Docs, LLC and for Affiliate Partners.  Together referred to a 'the Parties'.

1.  Purpose of Agreement

This Agreement outlines the terms under which the Affiliate will promote eSecureDoc's products and services in exchange for agreed-upon commissions.

2. Commission and Payment Terms 

- Commission Type: [Flat-fee or % of revenue]

- Commission Amount: [e.g., 30% of net revenue]

- Recurring or One-Time: [Indicate whether commission is recurring or one-time only]

- Payout Schedule: Monthly, by the 15th of each month for commissions earned in the previous month.

- Payment Method: [e.g., PayPal, Wise, bank transfer]

- Minimum Payout Threshold: [$50 USD]

 

Note: Commissions are only paid on successful conversions to paid customers. Free trial signups do not qualify.

Affiliates agree to:

- Promote eSecureDoc's software product honestly and in a way that reflects positively on the brand.

- Clearly disclose affiliate relationships, in line with FTC and GDPR requirements.

- Avoid making any false, misleading, or exaggerated claims.

- Not run paid ads using [Your Company Name] branded keywords.

- Follow all applicable laws and platform-specific advertising guidelines.

4.  Intellectual Property and Brand Use

Affiliates may use approved logos, banners, and other brand assets provided by eSecure Docs, LLC. They may not:

- Alter or modify brand assets

- Claim to be employees or official representatives

- Create marketing materials that imply false partnerships or endorsements

 

Affiliates must follow all brand guidelines, which will be provided upon acceptance into the program.

 

5.  Compliance and Data Protection

Affiliates must comply with:

- FTC disclosure rules for promoting affiliate products

- GDPR and other applicable privacy laws, especially when collecting or handling personal data

- Anti-spam regulations, including CAN-SPAM and similar laws in other jurisdictions

 

Failure to comply may result in immediate termination and forfeiture of unpaid commissions.

 

6. Tracking and Attribution

Affiliate sales are tracked via unique referral links provided by your company. Only referrals made through these links will be credited.

 

We are not responsible for tracking issues caused by:

- Ad blockers

- Browser settings

- Improper use of links

7.  Term and Termination

This Agreement begins on acceptance into the affiliate program  

- Either party may terminate at any time with written notice.

- Immediate termination may occur in cases of fraud, non-compliance, or brand misuse.

- Commissions earned before termination will be paid if they meet the payout threshold.

8. Governing Law

This Agreement will be governed by the laws of Texas, without regard to conflict of law principles.

This document constitutes the entire agreement between the Parties and supersedes any previous communications or understandings.
